Privacy Policy

The controller of your personal data is:

We process personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Slovak Act No. 18/2018 Coll. on Personal Data Protection. We have not appointed a Data Protection Officer because the law does not require us to. Please send any questions to the email above.

a) Contact form on bemarvelousdigital.sk: name, email address, phone number (optional) and the content of your message.

b) “Free website audit” form on audit.bemarvelousdigital.sk: name, email address, phone or WhatsApp number (optional), type of business, your website address and a link to your Instagram or Google profile (optional). When preparing the audit we also work with publicly available information about your website and business profile.

c) Communication: the content of emails, messages and calls you have with us.

d) Analytics data (only with consent, bemarvelousdigital.sk): visit data collected through Google Analytics, such as pages viewed, traffic source, device and browser type and approximate location.

e) Marketing data (only with consent, both Websites): data about your interaction with the Websites collected through the Meta Pixel, such as page views and form submissions, together with browser and device identifiers.

f) Technical data: IP address, browser type, operating system and time of access in server logs.

Providing data in the forms is voluntary. Without your name and email, however, we cannot reply to you or send the audit.

One reminder after the audit is sent if you do not reply: Art. 6(1)(f) GDPR, our legitimate interest in completing the conversation you started. You can object to this at any time.

Performing a contract if you decide to work with us: Art. 6(1)(b) GDPR.

Measuring traffic (Google Analytics): Art. 6(1)(a) GDPR, your consent.

Measuring advertising performance (Meta Pixel): Art. 6(1)(a) GDPR, your consent.

Security and operation of the Websites: Art. 6(1)(f) GDPR, legitimate interest.

Accounting and tax obligations: Art. 6(1)(c) GDPR, legal obligation.

We do not use form data to send newsletters or other marketing emails. That would require your separate consent.

Cookies are small text files stored on your device. We always use strictly necessary cookies; all others only with your consent under Section 109(8) of Slovak Act No. 452/2021 Coll. on Electronic Communications.

Consent is set separately for each Website. You can change or withdraw it at any time via the “Cookie settings” link in the footer. Withdrawing consent does not affect the lawfulness of processing before the withdrawal.

Contact form and audit form data: at most 2 years from our last communication, then deleted. Earlier at your request.

Contracts and invoices: 10 years under the Slovak Accounting Act.

Analytics data (Google Analytics): 14 months.

Marketing data (Meta): according to Meta's policies, at most 2 years.

Server logs: 30 days.

Consent preference cookie: 12 months.

We do not sell your data. We only share it with these recipients:

Mailchimp (The Rocket Science Group LLC, part of Intuit Inc., USA): processor, stores form submissions and contacts.

Google Ireland Limited and Google LLC: processor for Google Analytics on bemarvelousdigital.sk.

Meta Platforms Ireland Limited: joint controller for the Meta Pixel (see section 7).

Web hosting providers: processors operating the servers that run the Websites.

Accountant and public authorities: only where required by law.

Mailchimp, Google and Meta also process data in the USA. These transfers rely on the European Commission's adequacy decision for the EU-US Data Privacy Framework, under which these companies are certified, and additionally on standard contractual clauses.

When we use the Meta Pixel, we and Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland, are joint controllers for collecting data on the Websites and transmitting it to Meta. The allocation of responsibilities is set out in Meta's Controller Addendum (facebook.com/legal/controller_addendum). Meta alone is responsible for any further processing of that data; see Meta's Privacy Policy (facebook.com/privacy/policy). You can exercise your rights with us or directly with Meta.

The Meta Pixel only runs after you consent to marketing cookies.

Under the GDPR and Slovak Act No. 18/2018 Coll. you have the right to:

access your personal data (Art. 15 GDPR) rectify inaccurate data (Art. 16 GDPR) erasure (Art. 17 GDPR) restriction of processing (Art. 18 GDPR) data portability (Art. 20 GDPR) object to processing based on legitimate interest (Art. 21 GDPR) withdraw consent at any time, without affecting the lawfulness of prior processing (Art. 7(3) GDPR)

We do not make decisions based solely on automated processing, including profiling, that produce legal effects concerning you or similarly significantly affect you.

We apply appropriate technical and organisational measures to protect your personal data, in particular HTTPS encryption for all transmitted data, secure hosting infrastructure, access limited to authorised persons and regular security updates.

The Websites are not intended for children under 16. We do not knowingly collect their personal data. If you believe we have collected it unintentionally, contact us and we will delete it without delay.

We may update this policy from time to time. The current version is always published on this page with the date of the last update.
